The rapping actor, DMX will be able to duck jail time under a deal he's cutting with prosecutors over a road-rage fracas at Kennedy Airport.

In exchange for walking free, the bad-boy rapper will agree next month to take responsibility for the June 24 incident and carry a misdemeanor on his record, according to sources.

Both sides were close to an agreement last month, but the rapper, whose real name is Earl Simmons, could not bring himself to admit responsibility and nixed the deal, sources said.

But now he apparently has reconsidered his options.

DMX, 33, is facing at least two years behind bars on charges that he and a friend, Jackie Hudgins, 41, used unauthorized lights and sirens, crashed through a tollgate and chased another driver who was in front of them at a Kennedy Airport parking lot.

Cops said they found a billy club and crack cocaine in Simmons'' black Ford Expedition.

The recording and movie star has been in trouble before, including once in 1999, when cops found drug paraphernalia, a pistol and 13 pit bulls at his Teaneck, N.J., home.

But up to now, Simmons had managed to keep his record clean after paying a fine and doing community service reports the New York Daily.

"I''m pleased with the cooperation of the district attorney's office," said Simmons'' lawyer, Murray Richman, who would not comment on the deal.
